Daudzi Latvijas iedzīvotāji jau tagad aktīvi izmanto iespēju gūt papildu ienākumus, izmantojot savu dzīvokli, piedāvājot tādus pakalpojumus Airbnb, pārdodot savus radītos dizaina produktus tādos portālos kā Etsy, piedaloties pūļa finansēšanas formātos mūsu pašmāju veidotajos uzņēmumos, kā, piemēram, Mintos (kura pakalpojumiem, starp citu, vēl nav radīts skaidrs normatīvais regulējums valsts līmenī), vai pat piepelnoties, piedāvājot citiem kopbraukšanas pakalpojumus. Tā ir dalīšanās ekonomika jeb sharing economy, kas šobrīd pasaulē un Eiropā piedzīvo milzīgu izrāvienu. ASV šajā dalīšanās ekonomikā jau piedalās aptuveni 10 procenti iedzīvotāju, Eiropā - pieci procenti, taču paredzams, ka teju trešdaļa visu eiropiešu tuvākajā nākotnē izmantos dalīšanās ekonomikas piedāvātās iespējas. Šodien to jau ir izmantojusi vismaz trešdaļa Eiropas Savienības iedzīvotāju vecumā no 25 līdz 39 gadiem. Dalīšanās ekonomikas apgriezieni Eiropā dubultojas ik gadu. Un kādēļ gan ne? Tā ir iespēja efektīvi izmantot savus vai citu brīvos resursus, gūstot ienākumus vai patērētājiem sniedzot iespēju izvēlēties no plašāka un parasti daudzveidīgāka pakalpojumu klāsta. Vienlaikus šī dalīšanās ekonomika ir būtiska, aizraujoša un elastīga iespēju, piedāvājumu un inovāciju mājvieta, tā aktualizē būtiskus jautājumus par disciplīnu attiecībā pret nodokļu jautājumiem, patērētājiem un darbiniekiem, viņu tiesībām un aizsardzību. Šobrīd valsts līmenī neviena no dalīšanās ekonomikas aktivitātēm, lai kāda būtu tās izpausme, līdz galam neiekļaujas esošajā regulējumā. Var teikt, ka dalīšanās ekonomikas izaugsme pat izaicina esošo status quo ekonomiskās aktivitātes regulējumā. Šajā kontekstā valsts uzdevums ir nodrošināt patērētāju un darbinieku tiesību nepieciešamo aizsardzību un drošību, kā arī ieviest racionālus un godīgus spēles noteikumus visiem - gan dalīšanās, gan tradicionālās ekonomikas dalībniekiem. Līdzīgu situāciju mēs varējām novērot, kad Latvijas tirgū ienāca jauns kreditēšanas pakalpojums - īstermiņa kredīti jeb tautā dēvētie SMS kredīti. Arī tad šajā jomā bija normatīvās bāzes regulējuma vakuums, kā arī skaļi iebildumi no tradicionālās kreditēšanas sektora - banku - puses. Ar grozījumiem Autopārvadājumu likumā mēs varam spert soli uz priekšu dalīšanās ekonomikas segmenta sakārtošanā un beigt vilkties nopakaļ inovācijām un modernākajām ekonomikas izpausmēm, kas faktiski neregulētas eksistē vairākus gadus. Mēs diemžēl (saskaņā ar Eurostat datiem) inovāciju atbalsta un attīstības jomā iepaliekam aiz saviem kaimiņiem - Igaunijas un Lietuvas. Un lielā mērā tas saistīts ar inovācijām nedraudzīgu regulējumu. Pienācis laiks to mainīt, sākot ar grozījumiem Autopārvadājumu likumā, lai tādā veidā signalizētu gan sabiedrībai, gan uzņēmējiem par valsts vēlmi un gatavību Latvijā attīstīt pasaulē populārākos un inovatīvākos pakalpojumus. Kopbraukšanas pakalpojumus realitātē jau izmanto daudzi Latvijas iedzīvotāji un ārvalstu viesi. Mūsu uzdevums ir ieviest tiesisko bāzi, kas ļautu regulēt un aizsargāt gan patērētāju, gan šo pakalpojumu sniedzēju darbību šajā jomā. Neapšaubāmi, zinātniskā progresa labumi un jaunu tehnoloģiju progress uzņem arvien lielākus apgriezienus. Problēmas taksometru nozarē arī ir aktuālas jau gadu desmitiem. Tāpēc ir grūti noliegt, ka likumprojektam ir stiprās puses - patērētāju intereses, zemākas cenas, iedzīvotāju papildu piepelnīšanās iespējas, dinamiska tirgus attīstība un konkurences pieaugums. Tomēr ir arī vājās puses. Grozījumi, ar kuriem autori vēlas ieviest kopbraukšanas pakalpojumus, rada daudz neskaidrību un neatbildētu jautājumu, īpaši saistībā ar to, kā minētais jaunievedums ietekmēs situāciju autopārvadājumu jomā un transporta nozarē kopumā. Piemēram, nav izvērtēts, kā tas varētu ietekmēt valsts budžetu, dotāciju apjomu sabiedriskā transporta pakalpojumu sniedzējiem, nodarbinātības līmeni nozarē, nodarbināto darba samaksas iespējamās izmaiņas. Skaidrs, ka kopbraukšanas pakalpojumu sniedzēji var kļūt par konkurentiem taksometru nozarei, taču ar priekšrocībām. Mēs solidarizējamies ar Latvijas Sabiedrisko pakalpojumu un transporta darbinieku arodbiedrību, kā arī ar citiem nozarē strādājošajiem cilvēkiem, un frakcijas SASKAŅA deputāti nevar atbalstīt šo likumprojektu līdz galam neizstrādātā normatīvā regulējuma dēļ. Es prognozēju, ka likumprojekta virzības gaitā tiks iesniegti tādi priekšlikumi, kas būs ārpus apspriestā likumprojekta mērķa un tvēruma. Tāpēc aicinu darba grupu nopietni izdiskutēt un korekti atrisināt visus strīdīgos jautājumus. Eiropas Komisija savulaik bija sagatavojusi ziņojumu par Eiropā samērā jaunu lietu, kas pasaulē jau sen plaši pazīstama kā dalīšanās ekonomika. Ziņojumā norādīts, ka tā ir paradigmu maiņa attiecībā uz to, kā veidojas ekonomiskās attiecības. Tā ir jauna iespēja Eiropas Savienības dalībvalstīm, kurās šie pakalpojumi tagad plaši izplatās, savā ekonomikā papildus iegūt no 165 līdz 570 miljardiem eiro. Tās ir aptuvenās aplēses. Par to, ko mēs šobrīd debatēsim - vai to vajag vai nevajag -, citas valstis vairs nefilozofē. Viņu galvenās tēmas ir par to, kā dabūt daļu šī tirgus un kā šos pakalpojumus attīstīt. Tāpēc Eiropas Komisija aicina dalībvalstis izstrādāt savus attiecīgos regulējumus, salāgot tos ar nodokļu politiku, lai katrai konkrētai valstij no tā būtu labums arī caur nodokļu ieņēmumiem. Kas tas ir? Eiropas Komisija to sauc par ridesharing jeb kopbraukšanu, ja mēs tulkojam to latviski. Šī iniciatīva jau ir ieviesta praktiski visās Eiropas Savienības dalībvalstīs. Igaunijā, piemēram, šobrīd norit pilotprojekts un pēdējā lasījumā ir likumprojekts. Ja es saprotu, Lietuvā jau šobrīd ir pieņemts likumprojekts un pilnā sparā tas darbojas. Mēs esam tikuši līdz pirmajam lasījumam - pieci deputāti sadarbībā ar Ekonomikas ministriju ir izstrādājuši šo likumprojektu un parakstījuši iesniegšanai Saeimā. Ko paredz likumprojekts? Tas paredz pārdefinēt taksometru nozari, kurā šobrīd, kā zināms, ir ļoti liels ēnu ekonomikas īpatsvars. Likumprojekts paredz faktiski cilvēkiem “atbrīvot rokas” - atbrīvot iespēju piepelnīties arī transporta pakalpojumu sektorā, izmantojot mobilās tehnoloģijas, interneta tehnoloģijas, kas būtu tā platforma, kurā tu vari pieteikties un darboties, kur�� visi norēķini ir absolūti bezskaidras naudas, elektroniski, sasaistīti ar bankas karti. Tas nozīmē to, ka pretstatā šībrīža situācijai taksometru nozarē, kur pēc aplēsēm aptuveni 20 procenti ir relatīvi legālā zona un ēnu ekonomikas īpatsvars varētu būt 80 procenti, šajā gadījumā būs tehniskas iespējas simtprocentīgi izkontrolēt naudas plūsmu un izsekot, cik no tā visa pienākas Latvijas valstij nodokļos. Vakardien bija diskusija raidījumā “Krustpunktā”, un Igaunijas piemērs rāda, ka jau pilotprojektā, iesaistot 70 šoferus strādāt šādā regulējumā, viņi uzrāda savus ienākumus 1000 eiro mēnesī, pretstatā Latvijas taksometru nozarei, kur, rēķinot uz taksometru vadītāju skaitu, ienākumi ir apmēram 300 eiro. Manuprāt, jebkuram ir acīmredzami, ka šī summa ir neadekvāti maza pret to pakalpojumu apjomu, ko mēs redzam... ko ikdienā sniedz šie pakalpojumu sniedzēji. Likumprojekts paredz noteikt minimālās prasības... paredz tālāk to deleģēt Ministru kabinetam - noteikt to, kas ir drošības prasības... arī attiecībā uz autovadītājiem, kas varētu piedalīties šajā sistēmā... attiecībā uz automašīnām... Ir vesela sadaļa, kas ir saistīta ar nodokļu nomaksu. Proti, katram būtu jāreģistrējas kā nodokļu maksātājam. Un papildus tam es arī gribētu redzēt, ka Ministru kabinets sadarbībā ar Valsts ieņēmumu dienestu un Finanšu ministriju detalizēti izstrādā sistēmu, kādā veidā tiešsaistē var sekot līdzi šiem pakalpojumiem un redzēt naudas plūsmas, lai varētu izsekot arī nodokļiem. Likumprojekts paredz arī vairākas citas lietas (piemēram, definē, kas ir kopbraukšana) un dažādas citas nianses. Komisijā mēs šo likumprojektu izskatījām. Komisija to virza tālāk apspriešanai pirmajā lasījumā un aicina to atbalstīt, taču nosakot priekšlikumu iesniegšanas termiņu - pusotru mēnesi -, kas ir pietiekami garš, ņemot vērā to, ka satraukums šobrīd transporta nozarēs, tādās kā, piemēram, sabiedriskie pārvadājumi, starppilsētu pārvadājumi un taksometru industrija, kas ļoti satraukusies... šis satraukums ir liels, bet, manuprāt, tam nav īsti pamata. Līdz ar to, lai varētu visas šīs lietas izskaidrot, izdiskutēt un sagatavot ļoti prātīgus, pragmatiskus priekšlikumus, priekšlikumu iesniegšanas termiņš būs pusotrs mēnesis.
