Spēkā esošais Apsardzes darbības likuma regulējums paredz, ka speciālo atļauju (licenci) aizliedz izsniegt individuālajam komersantam vai komercsabiedrības pārvaldes amatpersonai, par kuru kompetentām iestādēm ir pamats uzskatīt, ka tas rada draudus valsts vai sabiedrības drošībai, taču ierobežojumi netiek attiecināti uz komercsabiedrības dalībniekiem, kuriem pieder daļas uzņēmumā, kas tiem dod iespēju ietekmēt uzņēmuma darbību, kā arī izmantot uzņēmumu vai tā resursus (piemēram, speciāli apmācītus un bruņotus apsardzes darbiniekus) dažāda rakstura darbību organizēšanai un veikšanai. Valsts un sabiedrības drošības interesēs ir veikt arī šādu personu pārbaudi no valsts drošības apdraudējuma viedokļa un attiecināt ierobežojumus arī uz komercsabiedrības dalībniekiem, lai kompetentas valsts iestādes varētu nodrošināt pilnvērtīgu kontroli un uzraudzību pār drošības pakalpojumu sniegšanas jomu un maksimāli savlaicīgi reaģēt uz iespējamo apdraudējumu gadījumā, ja komercsabiedrības potenciālā dalībnieka darbība būtu vērsta pret valsts vai sabiedrības likumīgajām interesēm. Kā otra izmaiņa paredzēts jauninājums attiecībā uz apsardzes sertifikāta saņemšanai nepieciešamās izglītības saturu. Šobrīd likumā noteikts, ka fiziskajai personai jāapgūst saskaņā ar profesiju standartu izstrādāta izglītības programma, taču līdz šim apsardzes nozarēs pastāvošās nevalstiskās organizācijas nav spējušas vienoties par apsardzes darbinieka profesijas standarta saskaņošanu un nav iespējams sagatavot arī saskaņā ar profesijas standartu izstrādātu izglītības programmu. Līdz ar to projektā paredzēts, ka apsardzes sertifikātu izsniedz fiziskajai personai pēc noteiktas izglītības iegūšanas vai izglītības programmas apguves un apsardzes darbinieka sertifikācijas pārbaudījumu nokārtošanas, nenosakot konkrētu izglītību un izglītības programmas veidu. Apsardzes sertifikāta saņemšanai nepieciešamo izglītību paredzēts noteikt Ministru kabineta noteikumos. Savukārt personai, kurai nebūs attiecīgās izglītības, apsardzes sertifikāta saņemšanai būs nepieciešams apgūt noteiktu izglītības programmu, piemēram, profesionālās pilnveides izglītības programmu, un nokārtot pārbaudījumus Valsts policijā. Šobrīd izglītības iestādes īsteno 160 stundu izglītības programmu atbilstoši iekšlietu ministra apstiprinātajam profesionālās pilnveides programmas “Apsardzes darbs” paraugam, kas 2014.gada 14.aprīlī ir apstiprināts Izglītības un zinātnes ministrijā. Komisijas vārdā aicinu atbalstīt likumprojektu pirmajā lasījumā.".
