Saskaņā ar tās 13.pantu mēs esam apņēmušies aizliegt visu veidu tabakas izstrādājumu reklāmu, tostarp jebkāda veida tiešās vai netiešās iniciatīvas, kas sabiedrību iedrošina pirkt tabakas izstrādājumus. Konvencijas 13.panta vadlīnijas noteic, ka tabakas izstrādājumu izvietojums tirdzniecības vietā ir produktu reklāma, kas veicina jeb stimulē tabakas izstrādājumu pirkšanu. Novietojums ir mārketinga instruments, kas rada iespaidu, ka tabakas izstrādājumu lietošana ir sociāli akceptējama; tas savukārt nestimulē smēķēšanas pārtraukšanu. Visjutīgākā grupa attiecībā uz šo produktu iegādes un lietošanas veicināšanu ir tieši jaunieši un bērni, jo pie kases ir novietoti - turpat pie saldumiem! - arī tabakas izstrādājumi, elektroniskās smēķēšanas ierīces, augu smēķēšanas produkti un tamlīdzīgi izstrādājumi. Lai nodrošinātu jebkādu veicinošo efektu izskaušanu, konvencijas dalībvalstis tiek aicinātas noteikt produktu izvietošanas un redzamības ierobežojumus, atzīstot, ka tirdzniecības vietās ir pieļaujama tikai rakstiska informācija par šiem produktiem un to cenām. Deputātu iesniegtā priekšlikuma redakcija atbilst tai praksei, kāda tiek realizēta arī citās valstīs. Somijā ierobežojumi šo produktu izvietojumam tirdzniecības vietās eksistē kopš 2012.gada, Īrijā - kopš 2009.gada; Lielbritānijā - kopš 2012.gada attiecībā uz lielveikaliem un kopš 2015.gada attiecībā uz pārējām tirdzniecības vietām. Islandē šāds aizliegums ir spēkā kopš 2001.gada, bet Norvēģijā - kopš 2010.gada. Priekšlikums neparedz tabakas un citu šādu izstrādājumu tirdzniecības aizliegumu, bet gan nosaka formu, kādā tiek organizēta nacionālā līmenī šī tirdzniecība. Viens no galvenajiem argumentiem, kas tiek izmantots, lai likumprojektā šobrīd šo priekšlikumu neatbalstītu, ir šāds: tas būtu saskaņojams ar Eiropas Komisiju, un tas kavētu likumprojekta pieņemšanas gaitu. Kolēģi! Ļaujiet paskaidrot, kāpēc priekšlikums nebūtu uzskatāms par tehnisko noteikumu projektu un neprasa saskaņojumu Eiropas Komisijā. Pirmkārt. Šim priekšlikumam, kas ir balstīts uz sabiedrības veselības aizsardzības apsvērumiem, ir ietekme uz patēriņa izmaiņām.
