Atļaujiet atgādināt, ka Latvijas Republikas likumdošana sniedz garantijas izglītības iegūšanai tikai valsts valodā. Citās valodās, to skaitā arī mazākumtautību valodās, iegūt izglītību var, bet garantiju tam valsts nedod. Citās valodās ir iespēja mācīties pašvaldību skolās, ja tās īsteno mazākumtautību izglītības programmas. Tātad mazākumtautību skolu Latvijā nav, bet ir skolas, kuras īsteno mazākumtautību izglītības programmas. Ja pašvaldība nolemj izbeigt tādas programmas īstenošanu skolā, apmācība tajā turpināsies kā skolā ar valsts valodu, proti, latviešu valodā. Pēdējo 20 gadu laikā dažu pašvaldību domes pretēji izglītojamo bērnu vecāku iebildumiem ir jau pieņēmušas lēmumus par skolu, kurās tika īstenotas mazākumtautību programmas, likvidāciju, tās pievienojot latviešu skolām un pārveidojot par divplūsmu skolām, bet pēc tam pārtraucot mazākumtautību izglītības programmu īstenošanu vispār. Minēšu konkrētu piemēru. 2009.gadā biedrībā “Latvijas Krievu mācībvalodas skolu atbalsta asociācija” (saīsinātais tās nosaukums - LAŠOR), kuru es esmu vadījis, vērsās Tukuma bērnu vecāki un lūdza atbalstīt viņu centienus panākt, lai bērnus uzņemtu 1.klasē, neskatoties uz to, ka Tukuma dome jau bija pieņēmusi lēmumu, ka Tukuma 3.vidusskolā 1.klase ar krievu mācībvalodu netiks komplektēta. Pašvaldības lēmums ir skolai saistošs, tāpēc vecāki saņēma skolas atteikumu uzņemt bērnus mazākumtautību izglītības programmas 1.klasē. Saņēmusi atteikumu, tukumniece Natālija Romanova iesniedza administratīvajā tiesā pieteikumu atzīt skolas lēmumu par prettiesisku un to atcelt. Pieteikuma pamatojums bija tas, ka Tukuma 3.vidusskolā jau tika īstenota licencēta mazākumtautību izglītības programma un ka savus bērnus mācībām 1.klasē pieteica vēl 13 bērnu vecāki - pat vairāk, nekā bija nepieciešams klases komplektēšanai. Tiesnese atteikusies pieņemt pieteikumu, pamatodama savu lēmumu ar to, ka domes lēmums par klases neatvēršanu ir uzskatāms par domes iekšējās pārvaldes lēmumu attiecībā uz savu iestādi, proti, skolu. Tāpat tiesnese skaidrojusi, ka (citāts) “nevienā normatīvajā aktā nav noteiktas privātpersonas tiesības iegūt vispārējo izglītību, mācoties savā, nevis valsts valodā, mazākumtautības programmā” un ka “pieteicējai nav tiesību prasīt, lai pašvaldība nodrošina viņas meitai vispārējās izglītības iegūšanu mazākumtautību izglītības programmā”. Tikmēr Latvija jau bija parakstījusi un 2005.gadā ratificējusi Eiropas Padomes Vispārējo konvenciju par nacionālo minoritāšu aizsardzību, tādējādi apņemdamās ievērot konvencijas 14.pantā noteikto, proti, “ja ir pietiekams pieprasījums, nodrošināt savu iespēju robežās, ka personām, kuras pieder pie nacionālajām minoritātēm, ir pienācīgas iespējas apgūt minoritātes valodu vai iegūt izglītību šajā valodā tajā teritorijā, kuru vēsturiski vai lielā skaitā apdzīvo nacionālo minoritāšu personas”. Izklāstītajā piemērā tiesa ir uzskatāmi demonstrējusi, ka esošais Latvijas tiesiskais regulējums nepārprotami nosaka un aizstāv valsts un pašvaldības tiesības, bet atstāj neaizsargātas mazākumtautībām piederīgo tiesības mācīties mazākumtautību valodās, jo pieprasījuma pietiekamība normatīvajos aktos nekā nav noteikta. Es iesniedzu priekšlikumu par tādu grozījumu Izglītības likumā, kurš līdzsvarotu publisko un fizisko personu intereses un noteiktu garantijas apmācībai Latvijas mazākumtautību valodās, ja pieprasījums izglītības iegūšanai mazākumtautības valodā ir pietiekams. Lai neļautu debatēm novirzīties no priekšlikuma būtības, es ierosinu pieprasījuma pietiekamības kritērijus noteikt Ministru kabineta noteikumos, nevis likumā.
