Bet, cienījamie kolēģi, kurš, jūsuprāt, Latvijas Republikā pieņem lēmumus par to, kādi nodokļi tiks maksāti, kas ir ar nodokli apliekamais objekts, kā šie nodokļi sadalās starp budžetiem (kurš ir valsts budžetam piekritīgs nodoklis, bet kurš - pašvaldību budžetam piekritīgs nodoklis), kādā proporcijā šie nodokļi sadalās? Tā ir Saeima. Un, ja mēs runājam par pašu resursu sistēmu, nekas nav citādi. Tas ir tieši tas pats. Kādi nodokļi tiks attiecināti kā pašu resursi, kāda daļa no šiem nodokļiem...? Kādi maksājumi tiks ieviesti? Kādā apmērā, kādā proporcijā? Kas būs ar nodokli apliekamais objekts? Tā ir tā jautājuma būtība. Un tāpēc, manuprāt, lēmums par būtību, par to, kas ir tie resursi, kurus mēs kā Latvijas valsts piekrītam deleģēt un deleģējam kā kopējos resursus Eiropas Savienības budžetā, un par to, kādā proporcijā, - tas lēmums ir Saeimas kompetencē. Jo viena lieta ir procedurāli saskaņot pozīciju kā tādu, bet pavisam cita - pēc būtības akceptēt lēmumu par to, kas veido pašu resursu sistēmu. Tāpēc es uzskatu, ka pēc Latvijā apstiprinātās konstitucionālās kārtības šāda lēmuma pieņemšana ir Saeimas kompetencē. Manuprāt, atbalstot šo priekšlikumu, nerodas nekādas grūtības, jo Saeimā lēmums ir pieņemts. Saeima pieņem ļoti daudz lēmumu; šeit ir izstrādātas procedūras, lai to darītu vēlreiz. Ja Eiropas lietu komisija apstiprina sarunu pozīciju, tas pēc būtības nav Saeimas lēmums par to, kāda, piemēram, būs pašu resursu sistēma. Vērtējot Latvijas Republikas likumdošanas kārtību, šādu lēmumu - kādi būs maksājamie nodokļi un to daļas - var pieņemt tikai pati Saeima. Mani izbrīna tās bailes, ja izrādīsies, ka Eiropas lietu komisija kaut ko būs lēmusi un Saeima pēc tam lems citādāk. Tad man ir jautājums - cik demokrātiski un plaši ir diskutēts par tiem lēmumiem, kurus pieņem Eiropas lietu komisija, ja pēc tam ir bailes, ka šie lēmumi var būt pilnīgi atšķirīgi vai diametrāli pretēji, nonākot Saeimas balsojumā. Budžeta un finanšu (nodokļu) komisijas sēdē par šo priekšlikumu, vienīgo priekšlikumu, bija pietiekami nozīmīgas debates, piedaloties arī Saeimas Juridiskā biroja pārstāvei, un šajās debatēs komisijas locekļu viedokļi sadalījās divās atšķirīgās grupās. Pirmais viedoklis bija tāds, ka Eiropas Savienības pašu resursu sistēma ir jāapstiprina Saeimai. Un otrais viedoklis, kurš atšķīrās no pirmā, bija tāds, ka Saeima attiecībā uz šo situāciju, par kuru ir runa šā likuma 15.1 panta pirmajā daļā, savu apstiprinājumu jau ir devusi un pietiek, ka šajā stadijā Ministru kabinets pārbauda, vai nav atšķirības no iepriekš Saeimas saskaņotās nacionālās pozīcijas. Atbilstības gadījumā Ministru kabinets to apstiprina pats. Ja tiek konstatētas atšķirības no iepriekš apstiprinātās Latvijas nacionālās pozīcijas, šī apstiprināšana atkal būtu jāveic Saeimai - pilnā ciklā caur Eiropas lietu komisiju. Pēc būtības debates bija par diviem jautājumiem. Pirmais jautājums: kā šī situācija izskatās attiecībā uz jautājumu par Saeimas iesaisti jeb līdzdalību lēmuma pieņemšanā par Eiropas Savienības pašu resursu sistēmu? Saskaņā ar Saeimas kārtības ruļļa 185.1 pantu Saeima savu līdzdalību Eiropas Savienības jautājumos realizē ar Eiropas lietu komisijas starpniecību, ja Saeima nav lēmusi citādi. No minētās normas izriet princips, ka Eiropas lietu komisija, lemjot par Ministru kabineta sagatavoto Latvijas Republikas oficiālo nostādni, pauž ne tikai savu, respektīvi, komisijas viedokli, bet caur šo lēmumu tiek īstenota Saeimas līdzdalība Eiropas Savienības jautājumos. Jāņem vērā, ka Eiropas lietu komisijā ir pārstāvētas visas Saeimā esošās frakcijas atbilstoši to proporcijām. Arī konkrētajā lietā, proti, attiecībā uz Latvijas oficiālo nostādni par Eiropas Savienības pašu resursu sistēmu, Eiropas lietu komisija jau ir lēmusi, proti, lēmusi par Ministru kabineta sagatavoto Latvijas Republikas oficiālo nostādni konkrētajā lietā. Un līdz ar to Saeima jau ir īstenojusi savu līdzdalību šī lēmuma pieņemšanā. Likumprojekta anotācijā ir īpaši norādīts, ka Ministru kabinets, īstenojot tam ar šo likumu deleģētās tiesības, vērtēs, vai tas atbilst iepriekš izstrādātajai Latvijas Republikas nacionālajai pozīcijai, kura ir tikusi apstiprināta Ministru kabinetā un saskaņota ar Saeimu. Tas nozīmē, ka Ministru kabinets būs tiesīgs atbalstīt vienīgi tādu lēmumu par Eiropas Savienības pašu resursu sistēmu, kurš atbilst Saeimas pozīcijai, ko konkrētajā lietā paudusi Eiropas lietu komisija, lemjot par konkrētās nacionālās pozīcijas apstiprināšanu. Šis princips ir iestrādāts pirmā lasījuma redakcijā, un ar otrā lasījuma redakciju mēs šo principu mainījām. Saeimas komisijas sēdē otrs diskusiju jautājums bija saistīts ar problemātiku, kura skar priekšlikumā paredzēto Saeimas lēmuma pieņemšanas procedūru, jo tā nav tik vienkārša kā tā, ko mēs esam izstrādājuši un pielietojuši iepriekš. Atbilstoši Saeimas kārtības rullim šāds lēmums, ja tā pieņemšana uzticēta Saeimai, būtu virzāms un izskatāms Saeimā kā patstāvīgais priekšlikums. Tas savukārt nozīmē to, ka, no procedūras viedokļa, nododot to komisijām, šajā lēmumā var tikt izdarīti arī grozījumi, turklāt teorētiski ir iespējams, ka šie grozījumi var būt arī tādi, kas atšķiras vai pat ir pretrunā ar Saeimas Eiropas lietu komisijas pieņemto lēmumu, izskatot attiecīgo nacionālo pozīciju, kas ir pausta Eiropas Savienības institūcijām. Pastāvot šādiem apstākļiem, izskatot attiecīgo patstāvīgo priekšlikumu, var veidoties juridiski neskaidra situācija. Proti, atkārtoti paužot Saeimas nostāju, tā var atšķirties no tās, ko Ministru kabinets, ievērojot Saeimas Eiropas lietu komisijā lemto, ir paudis Eiropas Savienības institūcijām iepriekš, vai pat būt pretrunā ar to. Ņemot vērā šos divus būtiskos apstākļus, es tomēr aicinu, lai mēs paliktu pie pirmā lasījuma redakcijas un neatbalstītu šo priekšlikumu. Paldies.".
