Pretēji tam, ko vēl pirms gada, kad mēs diskutējām priekšlikumus grozījumiem Enerģētikas likumā, kas paredzēja enerģētikas vai gāzes tirgus atvēršanu, pretēji tam, ko daudzi apgalvoja, ka nebūs nekādu alternatīvu gāzes piegādātāju, Klaipēdas sašķidrinātās gāzes terminālis darbojas jau gadu, un šobrīd pēc gada darbības arī gāzes pārvades sistēmas jauda no Klaipēdas līdz Kiemenai ir palielināta divas reizes. Tātad Latvija vairs nav izolēts tirgus, mēs neesam situācijā, kurā “Latvijas Gāzei” ir monopolstāvoklis. Cienījamie kolēģi! Arī pastudējot privatizācijas līgumu, ir skaidrs, ka jautājums par to, vai “Latvijas Gāzei” ir ekskluzīvas gāzes piegādes tiesības līdz 2017.gada aprīlim, nemaz nav tik skaidrs un varbūt pat tā nemaz nav. Turklāt Eiropas Komisija šobrīd ir norādījusi, ka uz Latviju tā sauktā derogācija vairs neattiecas, jo Latvija nav izolēts tirgus: Latvija šobrīd var saņemt sašķidrināto gāzi no Klaipēdas. Kolēģi! Elektroenerģijas ražotājs “Latvenergo” lielu daudzumu savas elektrības saražo (Sēdes vadītāja noklaudzina ar āmuru.), tieši pateicoties gāzei. Tad, kad “Latvenergo” vēlējās vienoties ar “Latvijas Gāzi”, lai varētu izmantot tās infrastruktūru un Inčukalnā noglabāt zināmu daļu gāzes, “Latvenergo” no “Latvijas Gāzes” nekādu pozitīvu atbildi nesaņēma. Tas nozīmē, ka bez šīs atbildes cieš mūsu patērētāji, jo šobrīd “Latvenergo” nav iespējas saražot lētāku elektrību. Kā Smiltēna kungs jau uzsvēra, Sabiedrisko pakalpojumu regulators apstiprināja noteikumus, kas uzliek par pienākumu “Latvijas Gāzei” ļaut izmantot infrastruktūru arī citiem piegādātājiem. “Latvijas Gāze” šos noteikumus ir apstrīdējusi, un šobrīd šie noteikumi ir apturēti. Mans priekšlikums ir tikai par to, lai šos noteikumus, kā citi var izmantot gāzi, paceltu Ministru kabineta lēmumu līmenī. Jau sākotnējā redakcijā, kuru iesniedza Ekonomikas ministrija, ir paredzēta šādu noteikumu izstrāde, taču to spēkā stāšanās ir paredzēta 2017.gada aprīlī. Kāpēc mums ir jācieš pusgads, ja mēs vairs neesam izolēts tirgus? Kāpēc “Latvenergo” ir jācieš un jāpērk dārgāka gāze no “Latvijas Gāzes”, ja ir iespējams pirkt lētāku gāzi no Klaipēdas un tādā veidā nodrošināt lētāku elektrību mūsu patērētājiem? Cienījamie kolēģi! Ja jūs atbalstīsiet manu priekšlikumu, tad situācija, kurā mums faktiski būs alternatīvi gāzes piegādātāji, iestāsies ātrāk - par pusgadu ātrāk! -, nekā šobrīd paredzēts. Un, pētot šo jautājumu, es neredzu juridiskus šķēršļus tirgus atvēršanai jau tagad, īpaši ņemot vērā Eiropas Komisijas viedokli, ka derogācija attiecībā uz tirgus atvēršanu ir beigusies. Iemesls, kādēļ tiek piedāvāts 2017.gada aprīlis, ir saistīts ar privatizācijas līgumu, kas it kā paredz “Latvijas Gāzei” ekskluzīvas tiesības būt vienīgajam tirgotājam līdz 2017.gada aprīlim. Taču - vai tā ir patiesība? Līdz šim es neesmu dzirdējis pārliecinošu pamatojumu, kādēļ, virzot likumprojektu, Ekonomikas ministrija ir izslēgusi līdz šim spēkā esošo regulējumu, kas noteic, ka gāzes tirgus atvēršana jāveic līdz 2017.gada 3.aprīlim vai pat agrāk, ja iestājas apstākļi, kad mums ir reāli savienojumi ar alternatīvajām gāzes piegādēm. Faktiski tādi jau ir šobrīd. Spilgts piemērs ir “Latvenergo”, kas vēlējās iegādāties gāzi no Lietuvas. Un tomēr “Latvijas Gāze” šo ieceri ir nobloķējusi, tiesā apstrīdot regulatora noteikumus. Jā, un par tiesvedību. Es vēlētos dzirdēt arī analīzi par šādu izmaiņu ietekmi uz tiesvedības procesu, kas šobrīd ir starp “Latvijas Gāzi” un regulatoru, proti, valsti. Pamatjautājums faktiski ir šāds: kādēļ ir jāpasliktina Latvijas valsts pozīcija šobrīd spēkā esošā regulējuma kontekstā? Lolitas Čigānes priekšlikums faktiski atgriež atpakaļ status quo, citiem vārdiem sakot, neļauj izslēgt jau esošo regulējumu, kas paredz gāzes tirgus atvēršanu jau šobrīd. Ekonomikas ministrija norādīja, ka šādu grozījumu pieņemšana radīs tiesību normu kolīziju, tomēr varbūt ir kāda iespēja rast juridiski korektu risinājumu un gāzes tirgu atvērt ātrāk - tieši tā, kā tas ir vēl spēkā esošajā redakcijā.".
