Likumprojekts “Tabakas izstrādājumu, augu smēķēšanas produktu, elektronisko smēķēšanas ierīču un to šķidrumu aprites likums” ir izstrādāts, pamatojoties uz nepieciešamību Latvijas normatīvajos aktos iestrādāt jaunas Eiropas direktīvas prasības par normatīvo un administratīvo aktu tuvināšanu attiecībā uz tabakas un ar to saistīto izstrādājumu ražošanu, noformēšanu un pārdošanu, kā arī pamatojoties uz Ministru kabineta informatīvajā ziņojumā noteiktajiem priekšlikumiem un Pasaules Veselības organizācijas konvencijas nosacījumiem. Jāsaka, ka šis likumprojekts, kaut arī ir izstrādāts kā jauns likums, lielā mērā un daudzos pantos pārņem līdz šim spēkā esošā normatīvā akta nosacījumus, un jauno nosacījumu nav nemaz tik daudz. Taču, ņemot vērā to, ka likums ir daudzkārt mainīts, saskaņā ar juridisko tehniku tas bija jāpieņem jaunā redakcijā. Valdība arī aicināja šo likumprojektu noteikt par steidzamu, pamatojoties uz to, ka ražotājiem pēc iespējas ātrāk būtu nepieciešams zināt marķēšanas un noformēšanas nosacījumus, lai piemērotu ražošanu līdz likumprojekta spēkā stāšanās brīdim šā gada maijā, kad ražot vairs ar veco iepakojumu nevarēs, taču tirgot ar to atbilstoši pārejas nosacījumiem varēs vēl veselu gadu. Tomēr, izskatot šo jautājumu, komisija secināja, ka šobrīd šīs marķējuma prasības patiesībā pilnā mērā nosaka Eiropas Savienības tiesību akti, un līdz ar to sadarbībā ar Veselības ministriju nav nekādu šķēršļu jau tagad ražotājiem sākt procesu pārveidošanu uz jauno marķējumu, kuru īstenībā Latvijas likumdošana nemaz nevar ietekmēt. Vienlaikus likumprojektā vēl ir virkne diskutējamu jautājumu. Un līdz ar to komisija nolēma nelūgt steidzamību, tomēr virzīt šo likumprojektu iespējami steidzamā kārtā, nosakot samērā īsu priekšlikumu iesniegšanas termiņu uz otro lasījumu. Turklāt pēc otrā lasījuma atbilstoši Ministru kabineta iekārtas... Veselības ministrija var sākt virzīt noteikumus, kuri jau šobrīd ir sagatavoti. Un visbeidzot. Komisija nolēma vērst Valsts kancelejas uzmanību uz to, ka ne tikai šis, bet arī virkne citu likumprojektu, kas saistīti ar direktīvas prasību ievērošanu, tiek iesniegti parlamentā ļoti vēlu, jau tuvu pārņemšanas termiņam, dažkārt pat to pārsniedzot, kā rezultātā Saeima tiek nostādīta tādā situācijā, kad nav pietiekami laika, lai šos likumprojektus varētu rūpīgi izdiskutēt. Komisija aicinās Valsts kanceleju šo situāciju nākotnē labot. Bet šobrīd komisijas vārdā aicinu apstiprināt šo likumprojektu pirmajā lasījumā.".
