Konstitucionālās vērtības, šķiet, mums visiem ir zināmas lietas, vismaz nepieciešamības gadījumā katrs no mums tās piesauc un aicina ievērot, cienīt. Un šķiet, ka tieši demokrātija un tautas suverēnās tiesības ir tās vērtības, ko mēs pieminam visbiežāk. Man kādreiz šķita, ka izpratne par šīm vērtībām nedrīkstētu mainīties. Sabiedrībai attīstoties, šo vērtību saturu var papildināt vai papildus nodrošināt, taču izrādījās, ka vērtību izpratne bieži vien ir atkarīga no tā, vai cilvēka rokās ir vai nav vara. Kā piemēru varu minēt notikumu mūsu Latvijas vēsturē. Pirms vairāk nekā pieciem gadiem kādas jaunas un daudzsološas partijas pārstāvji, kas tobrīd bija Saeimas opozīcijā, publiski cīnījās par to, lai nebūtu demokrātijas ierobežojumu, proti, lai, 10 tūkstoš vēlētājiem parakstoties, nebūtu jāmaksā pie notāra paraksta apliecināšanas summa, un aizgāja ar šādu pieteikumu uz Satversmes tiesu. Pēc daudziem gadiem šie paši cilvēki, tikai jau nokļūstot pie varas un kļūstot par noteicējiem lēmumu pieņemšanā, nobijās no savas tautas. Viņiem šķita, ka tauta nav pietiekami gudra, ka tā var sazvērēties un rīkoties pret Latvijas, proti, arī pret savām, interesēm. Lai sevi un tautu pasargātu no šādas rīcības, tapa likuma normas, kas ļāva tautai izvirzīt obligātas prasības pie nosacījuma, ka tās paraksta vairāk nekā 150 tūkstoši cilvēku. Vai tiešām kāds reāli domājošs Saeimas deputāts uzskata, ka bez īpašas finansētas kampaņas, bez reklāmas ir iespējams uzrunāt un aktivizēt 150 tūkstošus Latvijas vēlētāju, lai viņi aizietu, parakstītos un vēl samaksātu par to? Un vai tieši Latvijas iedzīvotājiem vienmēr būs šī nauda? Savulaik Satversmes tiesa atzina, ka ar konkrētā likuma normām Satversmes 1.pants nav pārkāpts, Saeima esot rīkojusies savas rīcības brīvības robežās. Taču vienlaikus arī likumdevējam tika uzdots pienākums - periodiski apsvērt, vai tiesiskais regulējums joprojām ir efektīvs un vai tas kādā veidā nebūtu pilnveidojams. Spriedumā bija skaidri ierakstīts - likumdevējam gan pārejas periodā, gan pēc 2015.gada 1.janvāra ir jāseko līdzi tam, lai apstrīdētajā regulējumā noteiktā kārtība būtu izpildāma un vēlētāji savas likumdošanas iniciatīvas tiesības varētu īstenot efektīvi. Es šogad centos īstenot savas pilsoņa tiesības - gribēju parakstīties par konkrētu likumdošanas iniciatīvu - un biju pārliecināts, ka tā kārtība jeb tā sistēma, par kuru tiesas sēdē ļoti pārliecinoši runāja Saeimas un valsts iestāžu pārstāvji, - proti, ka parakstīties esot viegli, ka to varot izdarīt jebkurā brīdī un elektroniski, un bez maksas, - ka tā sistēma darbojas. Izrādās, pie notāra nevar piekļūt uzreiz, bet ir jāpiesakās vairākas dienas uz priekšu. Ja neaizej ar savu lapiņu, tad ir jāmaksā vairāk nekā tikai paraksta apliecināšanas summa. Savukārt elektroniskai parakstīšanai, izrādās, ir vēl vajadzīgs nopirkt kaut kādu uzparikti pie datora, lai varētu nobalsot. Tātad šeit vienkāršajai tautai balsošana nav tik vienkārša. Šodien jums tiek piedāvāts likumprojekts, kas nedaudz atgriež atpakaļ tās labās idejas, kas savulaik likumā bija, protams, saglabājot arī to labo, kas savukārt bija jaunajā regulējumā, proti, gan procesa kvalitātes nodrošināšanu, gan kontroli, gan arī tiesas pieejamību. Otra novitāte šajā likumprojektā ir konsultatīvie referendumi. Ja jūs, deputāti, tiekaties ar saviem vēlētājiem, es ceru, ka jūs diezgan bieži varat dzirdēt to frāzi, ka plaisa starp lēmumu pieņēmējiem un tautu arvien pieaug. Šādā gadījumā lēmumu pieņēmēji ne vienmēr atceras to, ko bija solījuši. Un visasākā izpausme šajā gadījumā bija tieši saistībā ar bēgļu jautājumiem. Jaunais likumprojekts piedāvā šādās situācijās izmantot konsultatīvo referendumu. Es aicinu balsot “par” šo likumprojektu, un tādējādi jūs apliecināsiet, ka jūs uzticaties Latvijas vēlētājiem, ka jums nav bail no tā, ka tauta pati - ne tikai tās pārstāvji Saeimā! - var izlemt savu rīcību un pieņemt savus likumus.
