Likumprojekts izstrādāts, pamatojoties uz Eiropas Parlamenta un Padomes 2013.gada 22.oktobra Direktīvu par tiesībām uz advokāta palīdzību kriminālprocesā un Eiropas apcietināšanas ordera procesā, par tiesībām uz to, ka pēc brīvības atņemšanas informē trešo personu, un par tiesībām, kamēr ir atņemta brīvība, sazināties ar trešajām personām un konsulārajām iestādēm. Direktīvas un Norvēģijas finanšu instrumenta programmas “Latvijas korekcijas dienestu un Valsts policijas īslaicīgās aizturēšanas vietu reforma” projekta ietvaros likumprojekts paredz noteikt, ka meklēšanā esošās apcietinātās un ar brīvības atņemšanu notiesātās personas pēc to aizturēšanas var ievietot īslaicīgās aizturēšanas vietās uz laiku, kas nepieciešams to pārvietošanai uz izmeklēšanas cietumu vai brīvības atņemšanas iestādi, bet ne ilgāku par septiņām darba dienām. Tāpat paredzēts, ka īslaicīgās aizturēšanas vietā varēs ievietot arī Imigrācijas likumā noteiktajā kārtībā aizturētos ārzemniekus, izņemot mazāk aizsargātās personas - nepilngadīgus ārzemniekus, invalīdus, ārzemniekus vecumā, kuru sasniedzot Latvijas Republikā piešķir vecuma pensiju, grūtnieces, nepilnas ģimenes ar nepilngadīgiem bērniem un personas, kas ir cietušas no smagas psiholoģiskas, fiziskas un seksuālas vardarbības. Ārzemnieku izmitinās īslaicīgās aizturēšanas vietā, ja pastāv bēgšanas iespējamība, viņš rada draudus valsts drošībai vai sabiedriskajai kārtībai un drošībai un nav iespējams viņu izmitināt Valsts robežsardzes struktūrvienībās straujas aizturēto izraidāmo ārzemnieku skaita palielināšanās dēļ. Ņemot vērā minēto, esošos īslaicīgās aizturēšanas vietu pastaigu laukumus, lai tos pielāgotu likumprojektā paredzētajai minimālajai platībai, nebūs jāpārbūvē. Likumprojekts paredz noteikt, ka īslaicīgās aizturēšanas vietā iekārto telpu biometrijas datu iegūšanai un iekļaušanai biometrijas datu apstrādes sistēmā, kā arī aizturētā un tā sevišķo pazīmju fotografēšanai un kriminālistiskā raksturojuma sagatavošanai. Lai nodrošinātu normatīvajos aktos noteiktās cilvēka tiesības uz tīru un labvēlīgu, ar tabakas un augu smēķēšanas produktu dūmiem, kā arī elektronisko smēķēšanas ierīču tvaikiem nepiesārņotu vidi, paredzēts noteikt aizturētajiem aizliegumu smēķēt īslaicīgās aizturēšanas vietās. Likumprojekts paredz papildināt likumu ar normu, kas noteic, ka īslaicīgās aizturēšanas vietā tiek veikta videonovērošana. Tas ir vienīgais efektīvais līdzeklis, kas pilnīgi nodrošinātu īslaicīgās aizturēšanas vietās esošo personu drošību, maksimālu viņu uzvedības uzraudzību un iekšējās kārtības nodrošināšanu. Videonovērošanas mērķis ir ne tikai aizsargāt kārtības nodrošināšanas intereses īslaicīgās aizturēšanas vietā, bet arī pašu īslaicīgās aizturēšanas vietā ievietoto personu tiesības. Likumprojekts paredz noteikt, ka īslaicīgās aizturēšanas vietu drīkst apmeklēt diplomātiskās vai konsulārās pārstāvniecības pārstāvji, lai tiktos ar tajā ievietoto ārzemnieku vienatnē bez ierobežojuma. Ņemot vērā Valsts policijā no īslaicīgās aizturēšanas vietā ievietotajām un turētajām personām saņemto sūdzību skaitu un šo sūdzību saturu, kā arī tiesās iesniegto prasību saturu un spriedumu izvērtējumu, likumprojekts paredz uzdot Ministru kabinetam noteikt vienotas higiēnas prasības īslaicīgās aizturēšanas vietās.
