Likumprojektu komisijai nācās skatīt diezgan steidzami, jo likumam būtu jāstājas spēkā 2016.gada 20.maijā - atbilstoši Eiropas Savienības direktīvu nosacījumiem. Tāpēc arī liels paldies Saeimas Juridiskajam birojam un visām iesaistītajām ministrijām, jo īpaši Veselības ministrijai, kas ļāva sagatavot likumprojektu otrajam lasījumam pietiekami steidzami. Likumprojektam ir saņemti 46 priekšlikumi, taču vairākums no tiem ir juridiski tehniska rakstura un nemaina pēc būtības šo regulējumu. Līdz ar to detalizētāk pie tiem es nepakavēšos; vienīgais izņēmums ir 31. - deputāta Orlova un citu deputātu priekšlikums, par ko es runāšu atsevišķi. Taču papildus tam komisija bija saņēmusi gan tiesībsarga iebildumu, gan Juridiskā biroja lūgumu vērtēt likumprojekta 10.panta 10.apakšpunkta, kurš nosaka aizliegumu smēķēt transportlīdzekļu salonos un kabīnēs, atbilstību Satversmei. Komisija arī to detalizēti darīja savā sēdē. Atļaujiet īsumā rezumēt šos secinājumus, jo tie var būt būtiski likumprojekta tālākai virzībai, tātad arī tā iespējamai virzībai gadījumā, ja tas tiktu apstrīdēts kādās institūcijās. Latvijā jau šobrīd ir aizliegts smēķēt sabiedriskajos transportlīdzekļos, to skaitā taksometros. Eiropas Cilvēktiesību konvencijas 8.pants noteic, ka publiskās institūcijas nedrīkst traucēt nevienam baudīt tiesības uz privātumu, izņemot gadījumus, kas ir paredzēti likumā un ir nepieciešami, lai aizsargātu valsts vai sabiedrisko drošību vai valsts ekonomiskās labklājības intereses, lai nepieļautu nekārtības vai noziegumus, lai aizsargātu veselību vai tikumību vai lai aizstāvētu citu tiesības un brīvības. Mēs domājam, ka arī šis gadījums atbilst šiem ierobežojumiem. Smēķēšana transportlīdzekļa salonā vai kabīnē ir saistīta ar vairākiem riskiem. Smēķēšana kaitē pašu smēķētāju veselībai (tas tika detalizēti pamatots, bet to es šobrīd izlaidīšu), smēķēšana apdraud arī blakussēdētāju veselību. Automašīna ir noslēgta vide, tāpēc tajā ir augsts piesārņojuma līmenis. Ikviens, kurš iekāpj transportlīdzeklī, uzņem šīs kaitīgās vielas pat tad, kad nenotiek aktīva smēķēšana, jo kaitīgo vielu daļiņas nogulsnējas mīkstajos apvalkos un ilgstoši saglabājas transportlīdzekļa vidē. Tiek apdraudēta satiksmes drošība, jo smēķēšana tāpat kā runāšana pa mobilo tālruni novērš uzmanību un rada aizdegšanās draudus. Aizliegums smēķēt transportlīdzekļu salonos un kabīnēs attiecas arī uz elektroniskām smēķēšanas ierīcēm. Šobrīd pētījumos par šo produktu ietekmi uz veselību tiek vērtēta to lietošanas īstermiņa ietekme, jo šie produkti tirgū ir samērā nesen. Un līdz ar to ikvienas valsts vai indivīda uzdevums un pienākums ir nepakļaut līdzcilvēku veselību riskam, jo ir pierādījumi tam, ka elektroniskās smēķēšanas ierīces lietošanas rezultātā vidē izdalās kaitīgu vielu daļiņas, tostarp kancerogēnas. (Starpsauciens: “Par priekšlikumiem runā!”) Līdz ar to komisija izvērtēja un uzskatīja, ka šis priekšlikums atbilst Satversmei, un citi priekšlikumi netika iesniegti. (Starpsauciens: “Kāds ir priekšlikuma numurs?”) Tātad mēs runājam par 10.panta 10.apakšpunktu, kas nav atsevišķs priekšlikums. Līdz ar to atļaujiet ķerties pie iesniegtajiem priekšlikumiem. 1. ir Sociālo un darba lietu komisijas priekšlikums, kurš ir atbalstīts.".
