Saskaņā ar šobrīd spēkā esošo šeit skatāmā likuma 6.panta pirmo daļu speciālās ekonomiskās zonas vai licencētas kapitālsabiedrības par to īpašumā, tiesiskajā valdījumā esošo vai lietošanā piešķirto nekustamo īpašumu, kas atrodas zonas vai brīvostas teritorijā, ir tiesīgas piemērot nekustamā īpašuma nodokļa atlaidi 80 procentu apmērā no aprēķinātās nodokļa summas. Minētās nodokļa atlaides piemērošanai speciālajai ekonomiskajai zonai vai licencētai kapitālsabiedrībai nepieciešams saņemt zonas pārvaldes vai brīvostas pārvaldes atļauju, kas tai var tikt izsniegta tikai tad, ja izpildās šī likuma 5.panta otrajā daļā noteiktie specifiskie nosacījumi. Pašvaldībām, kuru teritorijās atrodas brīvostas vai speciālās ekonomiskās zonas, minētajos konkrētajos gadījumos nav tiesību piemērot no minētās atšķirīgu (minētā ir 80 procentu) nodokļa atlaidi un noteikt citus papildu nosacījumus atlaides piemērošanai, kā arī nodokļa atlaides samazināšanai. Savukārt saskaņā ar citu likumu - likumu “Par nekustamā īpašuma nodokli” - pašvaldības ir tiesīgas piemērot atsevišķām nekustamā īpašuma nodokļu maksātāju kategorijām nodokļa atvieglojumus 90, 70, 50 vai 25 procentu apmērā no nekustamā īpašuma nodokļa summas. Turklāt likuma “Par nekustamā īpašuma nodokli” 3.1 pantā ir noteikta nekustamā īpašuma nodokļa likme un nodokļa atvieglojumu noteikšanas principi, kas pašvaldībām jāievēro gadījumos, kad pašvaldības izmanto likumā tām deleģētās tiesības lemt par saistošo noteikumu izdošanu noteiktos gadījumos. Piemēram, viens no principiem ir teritorijas attīstības un teritorijas sakārtošanas princips, saskaņā ar kuru pašvaldība izmanto nodokļu likmi vai nodokļu atvieglojumus gan savas teritorijas attīstības veicināšanai, gan tās sakārtošanai. Lai novērstu aprakstīto situāciju, kurā pašvaldības nevar pilnvērtīgi pielietot tos nodokļu politikas instrumentus, kas ir paredzēti likumā “Par nekustamā īpašuma nodokli”, un lai veicinātu pašvaldību turpmāku patstāvību nekustamā īpašuma nodokļa atvieglojumu piemērošanā, ievērojot likumā “Par nekustamā īpašuma nodokli” noteiktos nodokļa atvieglojumu piešķiršanas principus, es iesniedzu šo priekšlikumu. Skatot šo priekšlikumu Budžeta un finanšu (nodokļu) komisijas sēdē, Finanšu ministrijas pārstāvji informēja, ka šī priekšlikuma atbalstīšanas gadījumā norma būtu atkārtoti jāsaskaņo ar Eiropas Komisiju, kas, protams, ir laikietilpīgs process. Komisijas sēdē, balsojot par šo manu priekšlikumu, bija vienāds “par” jeb atbalstījušo balsu skaits un “atturējušos” un “pret” balsojušo komisijas locekļu skaits. Līdz ar to, lai nekavētu šī likumprojekta tālāku virzību un lai to varētu paspēt pieņemt Saeimā galīgajā lasījumā līdz šīs sesijas beigām, es šobrīd savu 4. un arī nākamo, 5., priekšlikumu atsaucu. Vienlaikus es, kolēģi, jūs informēju, ka šobrīd notiek saskaņošanas darbs ar Finanšu ministrijas amatpersonām, lai uz šī likumprojekta skatīšanu trešajā lasījumā Saeimas sēdē varētu iesniegt manam priekšlikumam pēc būtības līdzīgu priekšlikumu, kura apstiprināšanas gadījumā Saeimā atbilstošā norma par nodokļu atlaidēm speciālajās ekonomiskajās zonās un brīvostās nebūtu atkārtoti jāsaskaņo ar Eiropas Komisiju.
