Viens no galvenajiem likuma grozījumu uzdevumiem ir pēc iespējas efektīvi nodalīt darbības, kas saistītas ar dabasgāzes tirdzniecību, no darbībām, kas saistītas ar dabasgāzes pārvadi un uzglabāšanu. Tāds ir likuma mērķis. Viens no visefektīvākajiem veidiem, kuru ir izvēlējušies arī mūsu kaimiņi - lietuvieši un igauņi -, ir pilnā īpašumtiesību nodalīšana (to izvēlējusies arī mūsu valdība), kas nodrošina pilnīgu pārvades un uzglabāšanas operatoru neatkarību no tādiem komersantiem, kuri nodarbojas ar dabasgāzes tirdzniecību vai iegūšanu. Kolēģi! Apstākļos, kad nepastāv nekāda īpašumtiesību saikne starp pārvades sistēmas operatoru un konkurences apstākļos strādājošu piegādes uzņēmumu, tiek radīta vide, kur vislabāk attīstīties konkurencei. Tieši šādos apstākļos pārvades sistēmas operators ir ieinteresēts pēc iespējas atvērti ikvienam tirgus dalībniekam nodrošināt piekļuvi savai sistēmai, savukārt piegādātājam nav iespēju tiešā veidā ietekmēt pārvades operatora darbību savās interesēs. Deputāta Meijas priekšlikums paredz, ka arī turpmāk esošie akcionāri (to skaitā - Gazprom un Itera) varēs tieši vai pastarpināti būt Latvijas dabasgāzes pārvades sistēmas un krātuves īpašnieki. To, cik šāds stāvoklis ir bīstams un nepieņemams, liecina šībrīža pieredze, kad “Latvijas Gāze” savu akcionāru interesēs liek dažādus šķēršļus trešo pušu piekļuvei un kaut mazākajai iespējai Latvijas tirgū parādīties konkurencei. Šobrīd izskan sūdzības no kaimiņvalstu tirgus dalībniekiem par ierobežotām iespējām izmantot Latvijas dabasgāzes sistēmu un krātuvi, lai veiktu pārrobežu darījumus un uzglabātu dabasgāzi Inčukalnā. Nav šaubu, ka, saglabājot Gazprom tiešu vai pastarpinātu kontroli pār šo stratēģisko un visai Baltijai nozīmīgo infrastruktūru, mēs faktiski pakļaujam riskam visu turpmāko Baltijas dabasgāzes tirgus attīstību. Savā ziņā tā būtu nodevība arī pret mūsu Baltijas kolēģiem, kuri apzinās, ka Latvijas tirgus regulējumam ir izšķiroša loma visas Baltijas tirgus attīstībā. Šādā redakcijā sagatavots priekšlikums (bez citām būtiskām izmaiņām likumprojektā) nozīmētu vēl vienu būtisku lietu. Tas nozīmētu arī likuma neatbilstību Eiropas Savienības Gāzes direktīvai. Kolēģi! Situācijā, ja tiek pieļauta dabasgāzes pārvades operatora atrašanās vertikāli integrēta dabasgāzes piegādes un tirdzniecības komersanta sastāvā, likumprojektā būtu jāparedz ļoti detalizēta un sarežģīta uzraudzības sistēma, kas teorētiski ir iespējama, tomēr pilnībā neizslēdz riskus, kuri saistīti ar viena piegādātāja vēlmi ierobežot citu komersantu darbību. Kolēģi! Tiesa, Eiropā pastāv atsevišķas valstis (un tas tika minēts arī komisijā), kurās eksistē modelis ar pārvades sistēmas operatora atrašanos vertikāli integrēta komersanta sastāvā, kā to piedāvāja Meijas kungs. Tomēr praktiski visos šajos gadījumos īpašnieki ir arī Eiropas Savienības dalībvalstu komersanti, un Eiropas Savienībā nav nevienas tādas valsts, kur Gazprom būtu būtiska līdzdalība nacionālās pārvades sistēmas operatoros. Līdz ar to konkrētais priekšlikums tā pašreizējā redakcijā padara likumprojektu par neatbilstošu Eiropas Savienības direktīvai, kā arī pēc būtības ir nepieļaujams, jo rada būtiskus draudus konkurencei, atvērta Latvijas un Baltijas dabasgāzes tirgus sekmīgai darbībai.
